Bufet Gómez Ferré operates on a success-fee basis for the recovery of debts that are well-documented, liquid, due and enforceable: you only pay when we recover your money. In court proceedings, our fees are equally charged in full to the debtor as legal costs, with no expense for the client.

Our fee model, explained with no small print

At Bufet Gómez Ferré we distinguish between two types of action, each with its own fee structure:

Out-of-court recovery

Before initiating court proceedings, we attempt to recover the debt through out-of-court means: demand letters, direct negotiation with the debtor and, since the entry into force of LO 1/2025 (MASC), the mandatory mediation or conciliation procedure.

Fees at this stage are calculated as an agreed percentage of the amount actually recovered. If nothing is recovered, nothing is charged.

  • No initial deposit required.
  • Percentage agreed with the client before starting.
  • Adapted to the type of debt and its amount.

Court proceedings — the debtor pays the costs

When the claim moves to court proceedings (payment order, summary proceedings up to €15,000 or ordinary proceedings for higher amounts) and the debtor has not paid during the process, the judge will issue a ruling imposing costs on the debtor, covering lawyer’s fees, court attorney’s rights and court fees. The client of Bufet Gómez Ferré bears no cost in this scenario.

In the exceptional cases where it is not possible to charge costs to the debtor (due to non-imposition of costs in the ruling), an agreed percentage of the principal and interest recovered is applied.

  • No upfront payment for the client, without prejudice to the adjusted deposit required by the other mandatory professional involved in court proceedings, the court attorney (procurador).
  • Fees 100% charged to the debtor in the event of a favourable ruling.
  • Alternative model (percentage) only if there is no costs award.

Frequently asked questions about fees for debt collection

It depends on the route taken. For out-of-court recovery, fees are a percentage of the amount recovered, agreed in advance with the client. In court proceedings, when the judge issues a favourable ruling, legal costs (including the lawyer’s fees) are imposed on the debtor, meaning the client of Bufet Gómez Ferré pays nothing. Only if it is not possible to charge costs to the debtor is a percentage applied to the amount recovered.

Legal costs are all expenses arising from court proceedings: the creditor’s lawyer’s fees, the court attorney’s rights and court fees. When the judge issues a ruling favourable to the creditor, the Spanish Civil Procedure Act (art. 394 LEC) establishes that the debtor must pay the costs of the proceedings. This means that the entire cost of the process falls on the debtor, not on the client who has retained the firm.

No. Bufet Gómez Ferré does not require an initial deposit to start the claim. Fees are charged solely and exclusively on the result: either as costs imposed on the debtor (court proceedings), or as a percentage of the amount recovered (out-of-court or court proceedings without costs award).
